1. Identification and Scope

2. Prices, Taxes and Quotes

• All prices are in Canadian dollars (CAD) before taxes (GST/QST not included) and before transport fees
• Prices are indicative and may change without notice. Only the price on the signed order confirmation is binding
• Quotes are valid for 30 calendar days from issue date
• Images on the site are illustrative only and do not constitute an exact contractual representation

3. Orders and Deposits

• All orders are confirmed by a signed sales contract and payment of a non-refundable deposit of 30% of the sale price (before taxes and transport)
• The deposit covers material costs and production initiated immediately after signing. It is non-refundable upon cancellation by Client
• The remaining balance (70%) is due before shipment or at delivery per contract terms

4. Transport and Delivery — CRITICAL CLAUSE

• 100% client fees: All transport costs including but not limited to: road transport, carrier rate, fuel surcharge, escort fees if required, oversize load permits, and marine crossing fees where applicable
• Variable departure point: The delivery departure location is determined by carrier availability and is not necessarily the Lévis, QC facility
• Free transport quote: A non-binding transport estimate is provided free of charge before order signing. Final amounts may vary
• Installation equipment: Client is responsible for arranging and paying for crane, knuckle boom truck or other equipment required to position the unit
• Non-guaranteed delivery dates: Delivery timelines are indicative. Delays beyond the Vendor's control do not entail liability
• Risk transfer: Risk of loss or damage transfers to Client upon loading at Vendor's location. Client is encouraged to purchase transport insurance

5. Client Responsibilities at Delivery

• Client must inspect the unit immediately upon delivery and note any visible damage on the delivery slip
• Claims for transport damage must be submitted in writing within 48 hours of delivery to info@maisonconteneur.com
• Client is responsible for adequate site access (road width, load capacity, level and stable surface, no overhead obstacles)

6. Product Dimensions and Descriptions

• All dimensions listed are nominal. A tolerance of ±5 cm (2 inches) applies per modular manufacturing standards
• Displayed colours may vary due to screen settings and available finishes at time of production
• Technical specifications may change without notice if changes do not substantially affect the product's main characteristics

7. Permits, Building Codes and Site Preparation

• Client is solely responsible for verifying and obtaining all permits required by their municipality, province and applicable regulations
• The Vendor provides available technical documentation to support permit applications but does not guarantee approval
• Site preparation (foundations, utility hookups, grading) is exclusively the Client's responsibility
• The Vendor cannot be held liable for costs incurred if the unit cannot be installed due to permit refusal or local zoning restrictions

8. Limited Warranty

8.1 Warranty Coverage

The Vendor provides a 10-year limited degressive warranty on the structural shell only, including: main steel structure, exterior walls, roof and structural floor. The warranty represents 100% replacement cost at year 1, decreasing 0.833% per month over 120 months.

8.2 Warranty Exclusions

• Plumbing, fittings, water heaters — Electrical systems and appliances
• Furniture, bedding, window coverings and decorative accessories
• Interior windows, decorative closures and interior finish materials
• Damage from improper installation, misuse, extreme weather, vandalism, or force majeure
• Installations not performed by certified professionals

8.3 Warranty Conditions

Warranty is conditional on: (a) installation on adequate foundations by certified professionals, (b) regular maintenance per provided instructions, (c) use consistent with the product's intended purpose.

9. Limitation of Liability

• The total liability of bKrazy inc. is strictly limited to the amount paid by the Client for the product in question, excluding transport fees
• Under no circumstances shall bKrazy inc. be liable for indirect, consequential, special, punitive or incidental damages, including but not limited to: lost revenue, lost rental income, lost profits, business losses, temporary housing costs, or bodily injury from improper use
• bKrazy inc. is not liable for zoning decisions, municipal permit refusals, or local regulations preventing installation

10. Cancellation and Refunds

• Before signing: No commitment — no cancellation fees
• After signing, before production start: Cancellation possible with loss of deposit (30%)
• After production start: No refund. Client remains liable for full balance if production is more than 50% complete

11. Force Majeure

bKrazy inc. is not liable for delays or non-performance resulting from events beyond its reasonable control, including but not limited to: natural disasters, epidemics, fires, strikes, material shortages, supply chain disruptions, or government decisions.

12. Intellectual Property

All content on MAISONCONTENEUR.COM (texts, images, plans, videos, trademarks, logos) is the exclusive property of bKrazy inc. or its licensors and is protected under Canadian copyright and intellectual property laws. Any reproduction without prior written authorization is strictly prohibited.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Quebec and applicable laws of Canada. Any dispute shall be submitted to the exclusive jurisdiction of the courts of the district of Quebec, Quebec. The parties agree to attempt mediation before any court proceedings.
